Terms of Service
The short version: buy it once, use it on two machines, don't resell it. If it doesn't work on your computer and we can't fix it, you get your money back within 14 days.
1. What you are buying
ClipSpotter ("the Software") is a Windows desktop application that analyses video files and cuts highlight clips from them. You are buying a perpetual, non-exclusive licence to use the Software — not the Software itself, and not the copyright in it.
2. The licence
Subject to these terms and to payment, you may:
- install and use the Software on up to two machines that you own or control;
- use the Software for personal and commercial work, including work you are paid for;
- use any clips you produce for any lawful purpose — including publishing, monetising and advertising.
You may not:
- copy, resell, sublicense, rent, lend or redistribute the Software or your licence key;
- publish or share the download;
- reverse engineer, decompile or disassemble the Software, except where that restriction is prohibited by law;
- remove or alter any copyright or licence notice;
- use the Software to infringe anyone's copyright or to process material you have no right to use.
3. Your content
You keep all rights to the videos you process and the clips you produce. We claim no licence over them and never receive a copy — the Software runs offline on your machine. You are solely responsible for having the rights to any footage you feed into it.
4. Delivery and activation
After payment you receive a download link and a licence key by email, and on the order confirmation page. The key activates up to two installations. Keep it — you will need it to reinstall.
Your licence is perpetual for the version you bought. Updates released during the life of the product are included at no extra cost. We may release a future major version as a separate product; existing licences continue to work for every version they were entitled to.
5. Refunds
Because this is a digital product delivered immediately, we do not offer refunds for change of mind. We do refund in full when:
- the Software does not run on your machine and we cannot resolve it after reasonable support effort; or
- you request a refund within 14 days of purchase for any other reason, provided you have contacted support first and given us a reasonable chance to help.
Refunds are issued to the original payment method by our merchant of record. To request one, email support@clipspotter.online with your order reference.
6. Support
Support is provided by email at support@clipspotter.online. We aim to answer within three business days. Support covers installation, activation and defects — not general video editing advice.
7. Third-party components
The Software bundles FFmpeg, which is licensed under the LGPL/GPL, and uses OpenCV, licensed under the Apache License 2.0. Source and licence texts for these components are included in the download. Nothing in these terms restricts your rights under those licences.
8. Warranty and liability
The Software is provided "as is". We do not warrant that it will be uninterrupted or error-free, or that its detection will select the clips you would have chosen yourself. To the maximum extent permitted by law, our total liability arising out of or relating to the Software is limited to the amount you paid for it.
Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
9. Termination
This licence terminates automatically if you breach clauses 2 or 3. On termination you must stop using and delete the Software. Clauses 3, 8 and 10 survive termination.
10. Governing law
These terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law rules. Disputes are subject to the jurisdiction of the courts of Estonia. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.
11. Merchant of record
Our order process is conducted by our online reseller Creem. Creem is the Merchant of Record for all our orders and handles all customer service enquiries relating to payment, billing, tax and refunds. By completing a purchase you also agree to Creem's terms.
12. Changes
We may update these terms for future purchases. The terms that apply to your purchase are the ones in force on the date of that purchase.
